Penalties & Consequences

Careless Driving Ticket FAQ

Is Careless Driving a criminal charge in Ontario?
No. Careless Driving is a provincial offence under Ontario’s Highway Traffic Act, not a criminal offence. However, it still carries serious penalties and insurance consequences.
How many demerit points does a Careless Driving conviction carry?
A conviction results in 6 demerit points added to your driving record. For novice drivers, this can result in an automatic suspension.
Can I fight a Careless Driving ticket in court?
Yes. You have the right to challenge the charge in traffic court. A paralegal can help you present a defence or negotiate a lesser charge.
Will this affect my insurance rates?
Absolutely. A conviction can lead to a dramatic increase in your premiums or difficulty getting insurance coverage altogether.
What if I didn’t cause any damage or harm?
Careless Driving doesn’t require harm to occur. It’s based on how your driving is interpreted by law enforcement — not just the outcome.
