Careless driving is regulated provincially, not under the Criminal Code of Canada. That means penalties differ depending on where you're charged. In Ontario, the Highway Traffic Act includes amendments for careless driving causing bodily harm or death.
Don’t confuse careless driving with dangerous driving — the latter is a criminal offence under section 320.13 of the Criminal Code. Careless driving involves operating a vehicle without due care or attention and is punishable with steep fines, licence suspension, or even jail time depending on the severity.
