Understanding Driving Under Suspension
In Ontario, driving while your licence is suspended is a serious offence under Section 53 of the Highway Traffic Act. A conviction can result in more than just fines—it can lead to further suspensions, jail time, and long-term financial consequences.
Reasons for suspension vary, but the legal consequences are always severe. JusticeJolt provides strategic defence to help minimize or eliminate these penalties where possible.
Penalties for Driving While Suspended
- First Offence: $1,000–$5,000 fine, 6-month suspension, and possible jail time up to 6 months
- Subsequent Offence: $2,000–$5,000 fine, further 6-month suspension, and potential jail time
Insurance & Financial Consequences
Driving while suspended often leads to years of inflated insurance rates—or difficulty finding coverage at all. In some cases, insurers may deny benefits if you're involved in a collision while suspended.
You may also become personally liable for injuries or damages caused in an accident, with no protection from your insurance provider.

What You Need to Reinstate
Before you can get a new licence, you will need to:
- Step 1: Pay any outstanding fines.
- Step 2: Complete any court processes/court-ordered programs needed to clear the suspension.
- Step 3: Gather any documents that state that the suspension has been lifted (e.g., a Notice of Suspension letter, a medical letter, an affidavit).
Once a suspension is lifted, you can renew your driver’s licence.
Why Was Your Licence Suspended?
- Unpaid traffic tickets or fines
- Medical conditions reported to the MTO
- Excessive demerit points
- Impaired or alcohol-related offences
- Convictions under the Criminal Code of Canada
- Failure to pay family support
What Are the Consequences?

- Fines up to $50,000 depending on offence history
- Vehicle impoundment (7 days or more)
- Potential jail time
