Understanding Driving Under Suspension

In Ontario, driving while your licence is suspended is a serious offence under Section 53 of the Highway Traffic Act. A conviction can result in more than just fines—it can lead to further suspensions, jail time, and long-term financial consequences.

Reasons for suspension vary, but the legal consequences are always severe. JusticeJolt provides strategic defence to help minimize or eliminate these penalties where possible.

Penalties for Driving While Suspended

  • First Offence: $1,000–$5,000 fine, 6-month suspension, and possible jail time up to 6 months
  • Subsequent Offence: $2,000–$5,000 fine, further 6-month suspension, and potential jail time
If your suspension was related to a Criminal Code conviction, fines may reach $25,000 on a first offence and $50,000 on subsequent offences.

Insurance & Financial Consequences

Driving while suspended often leads to years of inflated insurance rates—or difficulty finding coverage at all. In some cases, insurers may deny benefits if you're involved in a collision while suspended.

You may also become personally liable for injuries or damages caused in an accident, with no protection from your insurance provider.

What You Need to Reinstate

Before you can get a new licence, you will need to:

  1. Step 1: Pay any outstanding fines.
  2. Step 2: Complete any court processes/court-ordered programs needed to clear the suspension.
  3. Step 3: Gather any documents that state that the suspension has been lifted (e.g., a Notice of Suspension letter, a medical letter, an affidavit).

Once a suspension is lifted, you can renew your driver’s licence.

Why Was Your Licence Suspended?

  • Unpaid traffic tickets or fines
  • Medical conditions reported to the MTO
  • Excessive demerit points
  • Impaired or alcohol-related offences
  • Convictions under the Criminal Code of Canada
  • Failure to pay family support

What Are the Consequences?

  • Mandatory 6-month additional licence suspension
  • Fines up to $50,000 depending on offence history
  • Vehicle impoundment (7 days or more)
  • Potential jail time
  • Severe insurance rate increases or denial
  • Denial of accident-related benefits

Driving Under Suspension: FAQs

Is Driving under Suspension a Criminal Offence?
No. It is a serious offence under the Highway Traffic Act, not a criminal offence. However, consequences can include jail time, large fines, and extended licence suspension.
Can JusticeJolt help me avoid a conviction?
While no result is guaranteed, our experienced team evaluates the disclosure (evidence), your driving history, and court procedure to build the strongest possible defence.
What happens if I plead guilty?
In some cases, JusticeJolt can request a reopening of your case depending on the timing and reason for the plea. Contact us immediately if this applies to you.
Will this affect my insurance?
Yes. A conviction often leads to increased premiums or loss of coverage. Insurers treat this as a high-risk offence, particularly when tied to previous suspensions or criminal charges.
What is Disclosure?
Disclosure is the evidence package provided by the prosecutor, which includes officer notes and case details. It is a critical part of your defence. Learn more from the Ontario Court of Justice.
What types of suspensions can occur?
Your licence can be suspended by roadside officers, through a court order, or by receiving a notice from the Ministry of Transportation. Every suspension is considered serious, regardless of the method.
What Offences can result in a licence suspension?
Suspensions may result from offences like having alcohol in your blood, failure to insure your vehicle, evading police, collecting too many demerit points, unpaid fines or child support, failing to complete remedial programs, or medical conditions affecting safe driving.
