Hand-Held & Entertainment Device Charges

Under Ontario Regulation 366/09, it's illegal to use hand-held communication or entertainment devices while driving — even when stopped at a red light or stop sign.

This includes phones, tablets, MP3 players, DVD players, and similar devices. Unless calling 911, any interaction — touching, holding, or viewing — may result in charges under the Highway Traffic Act.

Penalties for Hand-Held/Entertainment Device Use

  • 1st offence: $500–$1,000 fine + 3-day licence suspension
  • 2nd offence: $500–$2,000 fine + 7-day licence suspension
  • 3rd+ offence: $500–$3,000 fine + 30-day suspension
  • Novice drivers: Face additional escalating sanctions

Yes. Ontario law prohibits holding or using a hand-held communication device while driving — even when stopped at a red light or stop sign. The only exception is if you're calling 911 during an emergency.
What’s the penalty for using a phone while driving?
For G-class drivers, penalties include:
