Hand-Held & Entertainment Device Charges
Under Ontario Regulation 366/09, it's illegal to use hand-held communication or entertainment devices while driving — even when stopped at a red light or stop sign.
This includes phones, tablets, MP3 players, DVD players, and similar devices. Unless calling 911, any interaction — touching, holding, or viewing — may result in charges under the Highway Traffic Act.
Penalties for Hand-Held/Entertainment Device Use
- 1st offence: $500–$1,000 fine + 3-day licence suspension
- 2nd offence: $500–$2,000 fine + 7-day licence suspension
- 3rd+ offence: $500–$3,000 fine + 30-day suspension
- Novice drivers: Face additional escalating sanctions
