Moving Ontarians More Safely Act
As of July 1st, Ontario is implementing the Moving Ontarians More Safely Act (MOMS Act) as part of the Ontario Highway Traffic Act. The MOMS Act was designed to further combat street racing, stunt, aggressive and unsafe driving on Ontario roads.
The Moving Ontarians More Safely Act, 2021, also known as the MOMS Act, will help protect people and families by targeting those who engage in stunt driving and unsafe, high-risk driving. The legislation also includes measures to protect vulnerable road users, such as pedestrians and highway workers, improve truck safety, and strengthen provincial oversight of the towing sector.

Stunt driving MOMS ACT
Highway Traffic Act – Section 172(1) – deals with Stunt Driving or Racing charges in Ontario is amended with respect to racing motor vehicles on highways and includes the following changes:
- Vehicle Impoundment from 7 days to 14 days
- Licence Suspension from 7 days to 30 days
- Under the Highway Traffic Act, you are Stunt Driving (or Racing) when your speed is greater than 50km / hour over the stated speed limit.
- Under MOMS ACT, Speeding 40 km/hour in a posted speed limit of 80 km/hour or less will be Stunt Driving

MOMS ACT e-bikes
The Act is amended with respect to motor assisted bicycles and power-assisted bicycles. The definition of “power-assisted bicycle” is amended to set out three different types of power-assisted bicycles.
Power assisted bicycle means:
- Pedal driven bicycle
- Two or three wheels
- Has pedals to propel the bicycle
- Has wheels of not less than 35 mm
- Has a motor power not exceeding 500 watts
